These Terms of Service ("Terms") govern use of Avanon Pulse, operated by Avanon LLC ("Avanon," "we," "us"), including the website avanonpulse.com, the dashboard at app.avanonpulse.com, and our messaging services. By using the service you agree to these Terms.
1. The service
Avanon Pulse provides AI-assisted communication for businesses: conversational agents that respond to the business's customers by text message and chat, along with related dashboard, analytics, and support features. Plans are month-to-month subscriptions billed via Stripe, with pricing determined at signup. New subscriptions include a 30-day money-back guarantee.
2. SMS program terms
Participating businesses receive a dedicated Avanon Pulse phone number. When a consumer texts that number, they are messaging the business, with replies generated by the business's AI assistant and team.
- Opt-in: consumers opt in by initiating a text conversation with a business's number, or by texting START where a business has invited them to do so.
- Opt-out: reply STOP at any time to stop receiving messages. A final confirmation message will be sent, after which no further messages will be delivered.
- Help: reply HELP for assistance, or contact avanonhq@gmail.com.
- Message frequency varies by conversation. Message and data rates may apply according to the consumer's carrier plan.
- Carriers are not liable for delayed or undelivered messages.
3. Acceptable use
Businesses using Avanon Pulse agree not to use the service for unlawful, deceptive, or abusive messaging; not to send marketing to consumers who have not consented; and to honor opt-outs. We may suspend accounts that violate messaging regulations or carrier policies.
4. Accounts and billing
Subscriptions renew monthly until canceled. You may cancel at any time from the dashboard or by contacting us; cancellation takes effect at the end of the current billing period. Within the first 30 days of a new subscription, you may request a full refund.
5. Intellectual property and data
Avanon retains all rights in the service and its software. Businesses retain rights in their own content and customer data; we process it only to provide the service, as described in our Privacy Policy.
6. Disclaimers and liability
The service is provided "as is." AI-generated responses may occasionally be inaccurate; businesses are responsible for reviewing critical information communicated to their customers. To the maximum extent permitted by law, Avanon's aggregate liability is limited to the fees paid in the three months preceding the claim.
7. General
